These Terms of Service ("Terms") govern your use of Limited Time Only ("LTO," "we," "us," or "our"), located at ltdtimeonly.com (the "Website"). By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Website.

1) About the Website

The Website provides informational content about limited-time menu items and promotions ("LTOs"), including community ratings/reviews and sponsored placements.

No affiliation: We are not affiliated with, endorsed by, or sponsored by any restaurant or brand unless explicitly stated. All trademarks, logos, and brand names are the property of their respective owners and are used for informational purposes only.

2) Accuracy and Availability Disclaimer

We strive to keep information current, but we do not guarantee the accuracy, completeness, or timeliness of any content on the Website, including pricing, ingredients, nutrition information, allergen data, or promotional availability. This information can vary by location and may change without notice. Always verify details directly with the restaurant before making purchasing decisions, particularly if you have food allergies or dietary restrictions.

3) User-Generated Content (Ratings, Reviews, Comments)

If you submit ratings, reviews, comments, or other content ("User Content"), you represent and warrant that:

  • It is truthful and based on your genuine experience to the best of your knowledge.
  • You have the right to post it and it does not infringe on any third party's intellectual property, privacy, or other rights.
  • It does not violate any applicable law or regulation.

Anonymous Ratings

LTO does not require account registration or login to submit ratings. Ratings are anonymous — we do not collect personally identifiable information in connection with ratings, and we cannot trace a rating back to a specific individual.

Moderation

We may (but are not required to) monitor, edit, or remove User Content at our discretion, including content that appears spammy, abusive, defamatory, misleading, or unlawful.

License to use your content

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, display, adapt, and distribute your User Content in connection with operating and promoting the Website.

California Minors — Content Removal

If you are a California resident under the age of 18, you may request removal of User Content you have publicly posted on the Website. To make such a request, email us at legal@ltdtimeonly.com with the subject line "California Minor Content Removal Request" and a description of the content you would like removed. We will process your request within a reasonable timeframe. Please note that removal may not ensure complete or comprehensive erasure from all systems, backups, or cached versions.

Some jurisdictions, including California, do not allow limitations on incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you.

10) Indemnification

You agree to defend, indemnify, and hold harmless LTO and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your User Content, your violation of these Terms, or your violation of any rights of another party.

11) Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, without regard to conflict of laws principles.

California residents: Notwithstanding the foregoing, if you are a California resident, you retain all rights afforded to you under California law that cannot be waived by contract, including but not limited to rights under the California Consumer Privacy Act (CCPA), the California Online Privacy Protection Act (CalOPPA), and the Unruh Civil Rights Act. Nothing in these Terms shall limit or waive those rights.

Dispute resolution: Any dispute arising out of or relating to these Terms shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution in the state or federal courts located in Ohio. California residents retain the right to bring claims in small claims court in their county of residence if the claim qualifies.

Complaints: California residents may also file complaints with the California Attorney General's office at oag.ca.gov or the California Privacy Protection Agency at cppa.ca.gov.

12) Children's Use

The Website is intended for a general audience and is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. Because LTO does not require account registration or collect personally identifiable information from users, children's privacy risks are minimal. However, if you believe a child under 13 has submitted content that should be removed, please contact us at legal@ltdtimeonly.com.

13) Accessibility

Because LTO does not collect or store personally identifiable information in its database, the risk of a data breach involving personal user data is minimal.

15) Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, display a notice on the Website for at least thirty (30) days. Your continued use of the Website after the updated Terms are posted constitutes your acceptance of the changes. We encourage you to review these Terms periodically.

16) Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law and, if necessary, deemed modified to the extent required to make it valid and enforceable. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which will remain in full force and effect.

If any provision cannot be modified to become enforceable, that provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

17) Entire Agreement

These Terms, together with the Cookie Policy and Privacy Policy, constitute the entire agreement between you and LTO regarding your use of the Website and supersede any prior agreements.
